The alcohol limits in Bosnia and Herzegovina

over 0.3 up to 0.8 g/kg → 50–250 KM · over 0.8 up to 1.5 → 100–300 KM · over 1.5 → 400–1,000 KM and wanton driving 2,000–3,000 KM

For most drivers the limit is 0.3 g/kg of alcohol in the blood: driving with more than that is a misdemeanour, while exactly 0.30 g/kg is not (Article 174, paragraph (2)). For drivers in the zero-tolerance group any measured amount above 0.0 g/kg is a misdemeanour.

The bands are written as „over … up to …“, so the lower bound is excluded and the upper one included. That is why 0.80 g/kg falls in the 50 to 250 KM band, while 0.81 g/kg falls in the 100 to 300 KM band.

The law is written in g/kg of blood and prescribes no conversion from breath. Enter the value exactly as it appears on the record or the order — the calculator converts nothing. On the result the law is cited in Bosnian, as it is written in the gazette: „čl.“ is an article, „st.“ a paragraph and „t.“ an item.

Penalties by the amount of alcohol

Over 0.3 up to 0.8 g/kg: 50 to 250 KM and one or two penalty points (Article 236). The law does not state an exact number here but „one or two“, so the calculator shows it as a range rather than choosing for the law. Example: 0.50 g/kg means 50–250 KM.

Over 0.8 up to 1.5 g/kg: 100 to 300 KM, two penalty points and a mandatory driving ban of one to four months, whose execution cannot be postponed (Articles 235 and 246). Example: 1.00 g/kg means 100–300 KM and a ban of one to four months.

Over 1.5 g/kg: 400 to 1,000 KM, two points and a ban of two to six months (Article 234a). Since 27 May 2026 the same driving is also wanton driving (Articles 42a and 234b): 2,000 to 3,000 KM, a six-month ban and two points. Where two provisions overlap, Article 21 of the Law on Misdemeanours of BiH gives one unified fine — for 1.60 g/kg the range is 2,000–4,000 KM. Points and bans are not added together.

One limitation travels with every such range: for misdemeanours committed in Republika Srpska the entity Law on Misdemeanours of Republika Srpska also claims jurisdiction, and its rules differ — there the unified fine must be lower than the sum, and protective measures are added together. Which law applies is not settled, so the calculator computes under the Law on Misdemeanours of BiH and says so beside the result.

Zero tolerance — who is in that group

Article 174, paragraph (3) forbids any alcohol to drivers of categories C and D (and subcategories C1 and D1) while they are driving such a vehicle, to drivers in public transport, to professional drivers while working, to driving instructors, to learner drivers during training, and to drivers under 21 or with less than three years of driving experience.

For them anything over 0.0 up to 0.3 g/kg is already a misdemeanour: a fixed fine of 50 KM, with no penalty points (Article 237, item 26a). Example: 0.20 g/kg for a young driver means 50 KM. Above 0.3 g/kg the same bands apply as to every other driver.

Drugs and refusing the test

Driving under the influence of drugs is punished with 100 to 300 KM, two penalty points and a mandatory ban of one to four months (Article 235, item 25) — and since 2026 it is wanton driving as well, whatever the amount. That is why the calculator shows a unified fine under Article 21 here too: 2,000 to 3,300 KM.

Refusing a test for alcohol or drugs has, since 27 May 2026, been punished with the top of the range — a fixed 1,000 KM, with two penalty points and a ban of two to six months (Article 234a, item 10, and paragraph (5)). Refusing is never cheaper than being tested.

When drink-driving becomes a criminal offence

No measured amount of alcohol is in itself a criminal offence. Driving under the influence becomes a criminal offence only when it actually endangers public traffic — danger to the life or limb of people, or injury or major damage — under the criminal code of the entity or of Brčko District (Criminal Code of FBiH Article 333, Criminal Code of RS Article 402, Criminal Code of BD Article 327). The calculator therefore shows no blood-alcohol threshold for a criminal offence, because the law contains none.

Where driving under the influence caused a road accident, the law prescribes higher ranges, longer bans and different points; those cases are not covered by the calculator.

Why the calculator does not estimate alcohol from drinks

The calculator starts from the value established by the police or a laboratory. It does not estimate what a given number of drinks would produce, because in practice such an estimate would be an answer to the question of how much may be drunk before driving — and no formula can answer that reliably.

The legal limit is a legal threshold for the offence, not a measure of fitness to drive: a driver counts as being under the influence even below the limit if a medical examination establishes signs of impairment (Article 174, paragraph (2)).
